Our mission is to create an AI driven retail experience. Our technology helps publishers improve their users’ retail shopping experiences. To do that, we show users personalized content and ads we think they’ll be interested in based on information we collect from users and other parties. In this Services Privacy Policy ("Privacy Policy”), we refer to users as “you” or “your”.

We know that you care how information about you is used and shared, and we appreciate your use of our services and your trust that we will do so with care. This Privacy Policy describes how we, Shopsense, Inc., and its affiliates collect and process your personal information through our websites, devices, products, services, and applications that reference this Privacy Policy (together "Services"). 

Services Available in United States

Our Services are only available to users within the United States. You may not use our Services if you are not located in those places, and we use location detecting technology to block or limit access to only users in those places. 

Information We Collect

1. Information that you provide

When you use Shopsense Services, you voluntarily share certain information including the following:

  • Account Information: When you create an account, we collect information like your name, email address, birthday, gender, and preferred language. 
  • Content: We collect information when you save or upload photos, or other content, provide voice input in connection with your product search, or interact with content (for example, sharing, commenting or adding a photo). 
  • Purchasing preferences: When you use our Services, including making purchases, we may collect information about your purchasing preferences, such as preferred retailers or checkout preferences.
  • Precise location information: Depending on where you live, you can choose to share your precise location using your device settings. 
  • Your communications with us: If you contact us for support or otherwise communicate with us, we collect the content of these communications. 

2. Information collected automatically when you use Shopsense

When you use a website, mobile application or other internet service, certain internet and electronic network activity information gets created and logged automatically and this is true when you use Shopsense. Here are some of the types of information we collect:

  • Device information: We collect information about the device you use to access our Services, including the type of device, operating system, network service provider, settings, and unique device identifiers.
  • Log data: When you use our Services, our servers record information (“log data”), including information that your browser automatically sends whenever you visit a website, or that your mobile app automatically sends when you’re using it. This log data includes, for example, your Internet Protocol (IP) address, identifier for advertisers, activity on websites, apps or properties you visit that incorporate Shopsense Services, browser type and settings, and the date and time of when you accessed the Services. 
  • Information from cookies and similar technologies: We also use “cookies” or similar technologies to obtain log data. For example, we use cookies to store your settings so you don‘t have to set them up every time you visit Shopsense. For more information about how we use cookies, please review our Cookie Policy.
  • Usage data and inferences. When you’re on our Services, we may collect information about your activity on a page or screen, such as which shows or content you watch, products you search for, terms you search for, and any text that you add in a comment or description. We also use other information you’ve provided when you first signed up as well as information from our partners and advertisers to make inferences about you and your preferences. For example, if you take a picture of, and search for, a handbag, we may infer you are shopping for similar types of goods. We may also infer other information, such as your education or professional experience. 
  • Location Information: We use your IP address to infer your approximate location, even if you don’t choose to share your precise location, and photos you share may include information about the location where they were taken.
  • User Choices: We will keep a record of choices you’ve selected in your settings, including privacy settings and whether you have enabled notifications.

3. Information we obtain from our partners and advertisers 

We also receive information about you and your activity outside Shopsense from advertisers, partners, and other third parties we work with. For example:

  • Third party platforms: If you register for or log into the Service using a third party platform, they will furnish certain information to us to facilitate your account creation or log-in with us. In addition, if you connect your third-party accounts to our Services, we may use information from those accounts to improve your experience. Further, some third-party applications use Shopsense features. If so, we may receive log data from those sites or apps, including usage data, to understand and analyze user engagement with our Services. 
  • Advertisers or other partners: Online advertisers or other third party partners may share information with us about you to measure, report on or improve the performance of ads on Shopsense, or to help us better understand what kinds of ads to show you on Shopsense. For example, we may receive information about your visits to an advertiser's site, or purchases you made from them, or information about your interests from a third-party service, which we might use to help show you ads or content on the Service that are more relevant to you. Sometimes we get this information through the Shopsense Tag (a piece of code an advertiser puts on their site), which delivers insights to us and our ad partners about actions that a person takes on their website after viewing an ad on our Services. 

 

How we use the information we collect

We want to show you content that’s relevant, interesting and personal to you. To do that, we use your information to provide and improve your experience, including to:

  • Identify you when you use our Services.
  • Recommend products or content you might like based on your activity on our Services and your offsite behavior. 
  • Communicate with you and respond to your questions or comments.
  • Allow searching with photos, if you choose. For example, if you take a photo of a pair of shoes or a piece of clothing you like, we may show you similar items. 
  • Provide voice, image and camera services. When you use these services, we use your voice input, images, videos, and other personal information to respond to your requests, provide the requested service to you, and improve our Services. Where you provide us with the personal information of third parties, such as images of other individuals, it is your responsibility to inform them about the processing of their personal information in accordance with this Privacy Policy, and to confirm that they have given their permission.
  • Depending on where you live, and with your consent, identify your precise location and customize your experience on our Services. You can opt in to (and out of) this in your device operating system settings.
  • Send you updates, including by email, push notification, SMS, or phone. You can unsubscribe from our promotional emails at any time by following the opt-out or unsubscribe instructions at the bottom of the email and decide to stop getting other notifications by updating your settings.

We use your information in our efforts to improve our Services, keep our users and the public safe, and to protect legal interests. To do so, we:

  • Review your activity and messages on our Services to detect spam or activity that poses a risk to our community or the public. This can include working with law enforcement to keep Shopsense safe.
  • Analyze users’ log data and device information to identify and investigate suspicious behavior or violations of our policies or Terms & Conditions.
  • May use personal information in relation to a legal claim, litigation, or regulatory proceeding. 
  • Conduct analytics and research on who is using our Services and what they are doing. For example, by logging how often people use two different versions of a feature on Shopsense, we can understand which version is better.
  • Improve our products and Services and offer new features, including to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of the Services.
  • Create aggregated or de-identified information that cannot reasonably be used to identify you. Shopsense processes, maintains, and uses this information only in a de-identified fashion for the purposes set forth in this Privacy Policy.

We also use your information to personalize the ads you see. Specifically, we use the information we collect to:

  • Decide which ads to show you. We customize the ad content we show you by identifying your interests based on your onsite and offsite activities, as well as by using information we receive from ad partners or other third parties. Where we use cookies to identify your offsite interests, we’ll get your consent where required. 
  • Advertise Shopsense products and services to you on other sites and apps. To do this, we disclose information such as cookie IDs, your IP address, or a hashed version of your email address to third parties, such as Facebook Ads, Google Marketing Platform, and others who may combine that information with other information they already have about you and deliver ads about Shopsense to you. To opt-out of our disclosure of your information to those third parties email us at contact@shopsense.ai.
  • Tell our ad partners how their Shopsense ads are doing, and how to make them better. To do this, we disclose information about the ads you see or interact with on Shopsense to our advertisers and third-party companies to improve the performance of the ads that we or they use to audit or improve the delivery and performance of ads or content on websites and apps. Some of this information is aggregated. For example, we would report to an advertiser that a certain percentage of people who viewed an ad went on to visit that advertiser's site. Depending on where you live and your settings, we may also disclose this information at an individual level. 

Some of these activities may be considered “targeted advertising”, “sharing” or “selling” as those terms are defined under certain state privacy laws in the US. You can opt out of Shopsense using and disclosing your information for these purposes. To do so, email us at contact@shopsense.ai

Your Rights and Choices

Where required by applicable law, we offer you certain choices to control your data. Depending on where you live, these choices may also be privacy rights you have under local law. To exercise these rights, please visit your account settings and, if you still need help, contact us at contact@shopsense.ai.  

  • Access: You can request access to the information we collect and hold about you, including sometimes in a portable format. 
  • Correction/rectification: You can correct your information by updating information in your profile.
  • Deletion/erasure: You can have your information deleted by emailing us at contact@shopsense.ai.  
  • Opt out of “targeted advertising” “sharing” or “sale”: As explained above some of our activities may constitute “targeted advertising,” “sharing,” or “selling” as those terms are defined under certain state privacy laws in the US. You may opt out at any time by emailing us at contact@shopsense.ai. Note that you will still see ads on our Services, but they will not be informed by offsite data. We do not knowingly permit users under the age of 18 to use our Services and thus will not knowingly “share” or “sell” information about users under 18
  • Additional rights, such as to opt out of the processing of your personal information for profiling in furtherance of decisions that produce legal or similarly significant effects, or withdraw your consent where applicable.

We will not discriminate against you if you choose to exercise your rights or options related to your personal information. These rights may be limited, for example if fulfilling your request would reveal personal information about another person, where they would infringe the rights of a third party (including our rights) or if you ask us to delete information which we are required by law to keep or have a compelling interest to keep. You have choices regarding your information on Shopsense. You may also have choices available to you through the device or software you use to access Shopsense. For example:

  • The browser you use may let you control cookies or other types of local data storage.
  • Your mobile device lets you choose how and whether your precise location, photos, and other data is shared with us.

How and when we disclose information

Anyone can see the public content you post. Depending on where you live, we also make this public information available through what are called APIs (a technical way to share information quickly). 

We may also disclose the categories of information described above:

  • To other services, at your direction. For example, when you decide to link your Shopsense account to third party services, such as a streaming service, you direct disclosure of certain information to those services. 
  • We disclose data for advertising and related purposes, including showing you ads about Shopsense on third-party services and helping advertisers understand how ads on Shopsense perform.  
  • To vendors that we employ to process information on our behalf based on our instructions and for the purposes described in this Privacy Policy. Some information we acquire may be collected by vendors on our behalf.
  • To law enforcement agencies, government agencies, or other parties in compliance with the law. For example, we may get requests for account information from law enforcement authorities like the police or courts. We only disclose information in response to such requests if we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of us or any person; or to detect, prevent, or otherwise address fraud, security or technical issues.
  • Within our corporate family of companies, including wholly-owned subsidiaries and affiliates. If we were to engage in a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding that involves the transfer of the information described in this Privacy Policy, we would share your information with a party involved in such a process (for example, a potential purchaser).

How long we keep your information

We keep your personal information only so long as we need it to provide Shopsense Services to you and fulfill the purposes described in this policy. When we no longer need to use your personal information and there is no need for us to keep it to comply with our legal or regulatory obligations, we’ll either remove it from our systems or de-identify it so that we can't use it to identify you.

Our policy on children's information

Children under 18 are not allowed to use Shopsense. If you are in a state or country with an older age requirement, you may only use the Services if you are at or over the age at which you can provide consent to data processing. 

How we make changes to this policy

We may change this policy from time to time and if we do, we’ll post any changes on this page. If you continue to use Shopsense after those changes are in effect, the new policy applies to you. If the changes are significant, we may provide a more prominent notice, such as by sending you an email.

We do not collect or process sensitive personal information about you for the purpose of inferring characteristics about you.

This Website Privacy Policy describes how Shopsense, Inc. and its affiliates (“Shopsense”, “we”, “us”, or “our”) handles personal information that we collect through our website https://www.shopsense.ai/ or through any other website that we own or control and which links to this Website Privacy Policy (collectively, the “Site”), and through other interactions with you, such as when you participate in events, apply for jobs with Shopsense or correspond with us.

We treat all personal information covered by this Website Privacy Policy as pertaining to individuals acting as business representatives, and not in their individual or household capacity.

This Website Privacy Policy does not apply to personal information relating to users of our Shopsense AI platform and related technologies that help publishers improve their users’ retail shopping experiences, which is governed by a separate <<Services Privacy Policy>>.

  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online.

Information we obtain from other sources: 

  • Social media information. We may maintain pages on social media platforms, such as LinkedIn. When you visit or interact with our pages on those platforms, you or the platforms may provide us with information through the platform.
  • Other sources. We may obtain personal information from other third parties, such as marketing partners, publicly-available sources, and data providers.

Automatic data collection. We and our service providers may automatically log information about you, your computer or mobile device, and your interactions over time with our Site, our communications and other online services, such as:

Retention

Job Applicants

If you apply for jobs through the Site, we collect the information that you provide to us in connection with your job application. This includes but is not limited to business and personal contact information, professional credentials and skills, educational and work history, and other information of the type that may be included in a resumé. This may also include diversity information that you voluntarily provide. We use this information to facilitate our recruitment activities and process employment applications, such as by evaluating a job candidate for an employment activity, to monitor recruitment statistics, and to respond to surveys.
